In China, public procurement encompasses both government procurement activities overseen by the finance departments and tendering activities coordinated by development and reform departments, with various administrative departments supervising in accordance with their responsibilities. Government procurement and tendering are part of the fiscal and trade disciplines, governed respectively by the Government Procurement Law and the Tendering and Bidding Law. Conflicts between these two laws in legislation, the overreach, misplacement, or absence of supervision and management departments in enforcement, and the clash of different perspectives from disputing parties in judicial processes often result in phenomena like "different practices for the same matter," "different penalties for the same behavior," and "different judgments for the same case." These occurrences indicate that public procurement needs more legal services. Unfortunately, due to the cross-disciplinary nature of public procurement and legal services as two distinct social sciences, procurement parties often feel that most lawyers are unfamiliar with government procurement and tendering, while many lawyers complain that the public procurement industry lacks legal understanding. The growing scale of public procurement has not led to an expansion or promotion of legal services in this field; the "massification" of public procurement contrasts with the "niche" nature of its legal services. Our team provides comprehensive legal services for the three parties involved in government procurement and tendering—procurement entities (bidders) and their agents, suppliers (tenderers), and government procurement or tendering supervision and management departments—covering the entire process from bidding to litigation across nine stages. Our services also include document drafting and revision, legal consulting services, and annual legal advisory services. We offer differentiated and precise legal services for different service targets.
3. Service Products
Over the years, our team has gradually developed a series of legal service products tailored to various entities and stages in the government procurement and tendering field. These products have evolved from "retail products" to "wholesale products" and from "customized products" to "general products," continuously improving in quality. The service details are refined, making it easier for clients to choose the most suitable product, and allowing lawyers who are unfamiliar with the field to consult relevant laws, regulations, administrative rules, and normative documents to provide the necessary legal services. In June 2021, our service product "Tender and Procurement Law Treasure" was reported by China Government Procurement News, recognizing it as a "refined" legal service product that offers more diverse options compared to others in the market. On August 25, 2022, this service product received a Work Registration Certificate from the National Copyright Administration.
