Trademark Agency Services
In response to the trademark registration needs of enterprises (individual businesses), we organize trademark applications and correction services.
I. Service Objectives
Assist enterprises (individuals) in completing trademark applications and ensure effective communication with the China National Intellectual Property Administration (CNIPA) during the review process to obtain exclusive trademark rights as soon as possible.
Assist enterprises (individuals) in securing trademark rights through review procedures.
File trademark opposition or invalidation requests on behalf of enterprises (individuals) to eliminate development obstacles.
II. Service Scope
(1) Trademark Registration Application
Trademark Search & Risk Assessment – Conduct trademark searches through the database to estimate the likelihood of successful registration.
Trademark Application – Prepare trademark application documents in accordance with the Trademark Law and its Implementing Regulations.
Communication During the Review Process – Handle interactions with the CNIPA Trademark Office.
Trademark Renewal – Monitor trademark status and provide timely renewal reminders for enterprises (individual businesses).
(2) Trademark Rejection Review
If a trademark application is fully or partially rejected, a review request may be submitted if the rejection decision is deemed erroneous.
Case Analysis & Review Necessity – Assess whether a review request is necessary.
Draft & Submit Review Opinions – Prepare and submit legal arguments for the review.
(3) Trademark Opposition
Within the statutory opposition period, any natural person, legal entity, or organization may file an opposition against a trademark that has undergone preliminary examination and has been published in the official gazette, requesting CNIPA to deny its registration.
Case Analysis & Review Necessity – Determine whether opposition is required based on the client’s existing trademarks.
Submission of Written Opposition – File opposition within three months from the preliminary approval announcement.
(4) Trademark Invalidation
For registered trademarks, any party may file an invalidation request based on absolute grounds, or a prior rights holder/interested party may file based on relative grounds, requesting the Trademark Review and Adjudication Board to declare the disputed trademark invalid.
Case Analysis & Evidence Preparation – Identify invalidation grounds and supporting evidence.
Draft & Submit Invalidation Petition – Prepare and submit written invalidation arguments.
